2. Nature of the Business Relationship

2.1 Proprietary Trading Arrangement

Excellence Traders Limited operates as a proprietary trading firm that provides qualified traders with access to simulated trading capital. This relationship is characterized by:

  • The Company retains ownership of all trading capital
  • Traders operate as independent contractors, not employees
  • All trading activities are conducted on simulated trading platforms
  • Profit sharing is based on predetermined arrangements
  • No guarantee of profits or trading success

2.2 Evaluation and Funding Process

The business relationship involves multiple phases:

  • Evaluation Phase: Traders demonstrate skills through challenge programs
  • Verification Phase: Review of trading performance and rule compliance
  • Funding Phase: Access to funded trading accounts upon successful completion
  • Performance Monitoring: Ongoing assessment of trading activities

2.3 Independent Contractor Status

Traders acknowledge and agree that:

  • No employment relationship exists between the parties
  • Traders are responsible for their own tax obligations
  • No employee benefits are provided
  • Trading schedules and methods are at the trader's discretion
  • The Company does not provide investment advice

3. Account Types and Capital Allocation

3.1 Evaluation Accounts

During the evaluation phase, traders receive access to:

  • Simulated trading capital ranging from $5,000 to $200,000
  • Real market conditions with live price feeds
  • Professional trading platforms (MT4, MT5, cTrader, or proprietary)
  • Access to major forex pairs, commodities, indices, and cryptocurrencies
  • Real-time performance monitoring and reporting

3.2 Funded Trading Accounts

Upon successful evaluation completion, traders receive:

  • Access to funded trading accounts with real profit potential
  • Capital allocations based on evaluation performance
  • Ongoing access to professional trading infrastructure
  • Regular profit sharing distributions
  • Opportunity for account scaling based on performance

3.3 Account Scaling and Growth

Successful traders may be eligible for:

  • Account size increases based on consistent profitability
  • Enhanced profit split arrangements
  • Access to additional trading instruments
  • Priority customer support and services
  • Invitations to exclusive trader programs

4. Trading Rules and Risk Management

4.1 Risk Parameters

All trading activities must adhere to the following risk management rules:

5. Profit Distribution and Payment Terms

5.1 Profit Split Structure

Profits from funded trading accounts are distributed as follows:

Initial Phase

  • Trader: 80%
  • Excellence Traders Limited: 20%
  • Minimum payout: $50
  • Processing time: 1-3 business days

After First Payout

  • Trader: 90%
  • Excellence Traders Limited: 10%
  • Minimum payout: $50
  • Processing time: 1-3 business days

5.2 Payout Schedule

Profit distributions are processed according to the following schedule:

  • Bi-weekly payout requests for funded accounts
  • Minimum 14-day holding period after account funding
  • Automatic processing for amounts above minimum threshold
  • Manual review for large or unusual payout requests
  • Holiday and weekend processing delays may apply

5.3 Payment Methods

Available payout methods include:

  • Bank wire transfer (1-5 business days)
  • Cryptocurrency payments (same day processing)
  • Digital payment platforms (PayPal, Skrill, Neteller)
  • Payment method availability varies by jurisdiction
  • Processing fees may apply based on payment method

5.4 Tax Considerations

Important tax information for traders:

  • Traders are responsible for all tax obligations in their jurisdiction
  • The Company may issue tax documentation as required

  • Record keeping is the trader's responsibility

6. Technology and Platform Access

6.1 Trading Platforms

The Company provides access to professional trading platforms including:

  • MetaTrader 4 (MT4) with custom indicators and EAs
  • MetaTrader 5 (MT5) with advanced order types
  • cTrader platform with advanced charting
  • Proprietary trading platforms where available
  • Mobile applications for iOS and Android

6.2 Market Data and Infrastructure

Traders receive access to:

  • Real-time market data feeds from tier-1 liquidity providers
  • Low-latency execution with minimal slippage
  • Comprehensive historical data for backtesting
  • News feeds and economic calendar integration
  • Advanced charting tools and technical indicators

6.3 System Requirements and Availability

Platform access is subject to:

  • Stable internet connection requirements
  • Compatible operating system and browser
  • Scheduled maintenance windows with advance notice
  • 99.5% uptime target (excluding scheduled maintenance)
  • 24/5 technical support during market hours

7. Compliance and Regulatory Matters

7.1 Regulatory Compliance

Excellence Traders Limited operates in full compliance with:

  • Financial services regulations in our jurisdiction
  • Anti-money laundering (AML) requirements
  • Know Your Customer (KYC) procedures
  • Data protection and privacy laws
  • International sanctions and compliance requirements

7.2 Client Obligations

Traders must comply with:

  • Accurate disclosure of personal and financial information
  • Ongoing compliance with identification requirements
  • Reporting of significant changes in circumstances
  • Adherence to all applicable laws and regulations
  • Cooperation with compliance reviews and audits

7.3 Record Keeping

The Company maintains comprehensive records of:

  • All client communications and transactions
  • Trading activities and performance metrics
  • Compliance documentation and procedures
  • Risk management and monitoring activities
  • Financial transactions and profit distributions

8. Account Termination and Dispute Resolution

8.1 Voluntary Termination

Traders may terminate their account by:

  • Providing 30 days written notice
  • Closing all open trading positions
  • Completing all outstanding obligations
  • Requesting final profit distribution
  • Returning any company-provided materials

8.2 Involuntary Termination

The Company may terminate accounts for:

  • Violation of trading rules or risk parameters
  • Breach of this Agreement or Terms of Service
  • Fraudulent or illegal activities
  • Failure to maintain compliance requirements
  • Extended periods of account inactivity

8.3 Dispute Resolution Process

Disputes are resolved through the following process:

  2. Escalation to compliance and legal department
  3. Good faith negotiation between parties
  4. Mediation by independent third party if needed
  5. Binding arbitration as final resort

9. Amendment and Modification

9.1 Agreement Updates

This Agreement may be modified by the Company:

  • With 30 days advance written notice

  • To improve service quality or security
  • To clarify existing terms and conditions
  • Subject to client acceptance of material changes

9.2 Client Acceptance

Continued use of services after notification constitutes acceptance of changes.

  • Regulatory or compliance accommodations

Agreement Acceptance

By registering for and using Excellence Traders Limited services, you acknowledge that you have read, understood, and agree to be bound by this Client Agreement in its entirety.
